Terms of use

These Terms of Use define the terms of access to and use of the XVAR mobile application. XVAR is a digital football scouting and matchmaking platform. Using its scouting technology, XVAR identifies the best talent, both amateur and professional, and showcases it to the clubs in its network and its partner scouts. For players without representation, XVAR may facilitate an introduction to licensed partner agents. Any use of the application implies unreserved acceptance of these Terms of Use.

User: any person accessing the application, whether a player, recruiter, institution, or fan.

Player: any person creating a profile to share their videos and performances.

Recruiter / Club: an entity using XVAR to identify, contact, or follow players.

Content: all videos, images, comments, profiles, and data published or shared on the application.

XVAR Talent: the space dedicated to amateur players and young talent.

XVAR Pro: the space reserved for professional players whose status has been verified by XVAR based on supporting documentation.

XVAR Connect: XVAR’s team, which may communicate with Pro players through the in-app messaging.

XVAR network club: a club or sports institution with which XVAR maintains a collaborative relationship.

Partner scout: an independent recruiter or observer collaborating with XVAR.

Licensed partner agent: a football agent holding a licence issued by the competent authority (FIFA or a national federation), independent of XVAR, with whom XVAR collaborates.

XVAR is a technology platform for scouting and matchmaking. XVAR is not a sports agent and does not carry out any agent activity within the meaning of applicable regulations, including the FIFA Football Agent Regulations. Accordingly, XVAR does not represent any player or club, and does not negotiate or sign any employment or transfer contract on behalf of a user.

Professional players: XVAR showcases the profiles of Pro players to the clubs in its network and its partner scouts. The Pro player remains represented by their own agent, who alone is authorised to negotiate and conclude on their behalf. Identified opportunities are shared with the player and, with their consent, with their agent.

Players without representation: when a player is not bound to any agent, XVAR may, with their consent, put them in contact with one or more licensed partner agents. Any representation, negotiation, or finalisation of a placement is the sole responsibility of those agents, under a contract concluded directly between the player (or their legal representative if they are a minor) and the agent.

The clubs, scouts, and agents in the XVAR network are independent of XVAR. XVAR is not a party to any representation, employment, or transfer contract, and does not guarantee that a player will be identified, put in contact with an agent, recruited, or placed with a club.

Registration is required to access XVAR’s main features. The user undertakes to provide accurate, complete, and up-to-date information, and to regularly update their account where applicable. It is prohibited to create multiple accounts for the same person, to impersonate a third party, or to use an account in someone else’s name without their authorization. In the event of non-compliance, XVAR reserves the right to suspend or delete the account concerned, without prior notice.

The user undertakes to use XVAR in compliance with Moroccan law, the rights of third parties, and the values of sport and the XVAR community. It is strictly prohibited to publish or distribute content that is violent, defamatory, discriminatory, hateful, pornographic, that infringes privacy or the rights of others, or that incites hatred or any illegal behavior. Any attempt at hacking, circumventing security features, unauthorized commercial exploitation of the platform, or misuse of the services will result in immediate deactivation of the account and, where applicable, legal proceedings.

Users retain their intellectual property rights over the videos and other content they publish via XVAR. By publishing content, the user declares that they hold all necessary rights and authorizations (notably regarding image rights and copyright) and indemnifies XVAR against any third-party claims. The user grants XVAR a non-exclusive, worldwide, free, and transferable license allowing it to reproduce, represent, adapt, and distribute the content on the application, on social networks, and on any XVAR communication medium, solely for the purposes of promoting, communicating about, or showcasing the platform and talent. XVAR undertakes not to modify content in a misleading manner or in a way that would harm the reputation or rights of the persons concerned. Any person may request the removal of content concerning them by writing to contact@xvar.ma; XVAR will review the request and, where there is a legitimate ground or legal obligation, will remove it within a reasonable time.

XVAR is a platform dedicated to detecting and promoting young talent from the age of 8. Use of the application by minors aged 8 to 17 is strictly subject to the prior consent and active supervision of their parent or legal guardian. By authorizing the creation of an account and the use of XVAR by the minor, the parent or legal guardian assumes full responsibility for the information provided, the activities carried out, and the content published by the minor on the platform. XVAR cannot be held responsible for any failure to fulfill this parental obligation. The platform reserves the right to limit, suspend, or delete any account or content deemed inappropriate or risky for the minor or for the community. Parents or guardians may at any time request deletion of the account and associated data by contacting contact@xvar.ma.

XVAR acts as a content hosting platform and does not exercise systematic editorial control over what users publish. Each user is solely responsible for the content they post, the information they communicate, and the interactions they have with other members. XVAR is not liable for direct or indirect damages resulting from: (i) the use of or inability to use the application, (ii) the behavior or content of other users, or (iii) any damage resulting from facts attributable to the user themselves or to a third party. XVAR nevertheless undertakes to diligently handle notifications and reports of unlawful content or content contrary to sporting ethics, and to remove or disable access to such content when it appears manifestly unlawful. XVAR cannot be held liable for the decisions, commitments, or failures of clubs, recruiters, institutions, or licensed partner agents, nor for the outcome of any discussions or negotiations conducted with them.

XVAR may suspend, limit, or delete a user account, without prior notice, in the event of non-compliance with these Terms of Use, suspicion of fraudulent activity, a threat to the security of the platform, or a serious infringement of third-party rights. The user may, for their part, request deletion of their account at any time via the application settings or by writing to contact@xvar.ma. Deletion of an account does not prevent XVAR from retaining, for the legally authorized period, certain data necessary for evidence or the management of potential disputes.

XVAR reserves the right to amend these Terms of Use at any time to take into account changes to the platform’s features, the legal framework, or recommendations from competent authorities. Any substantial amendment will be notified via the application or by email. Continued use of the application after notification of the new terms constitutes acceptance of them. If the user does not accept the amendments, they must stop using XVAR and request deletion of their account.
